Privacy policy

We have written our privacy policy to be understandable for humans (not just lawyers). By using the vitalCustomer software product, you consent to processing of data concerning you in accordance with the privacy policy.

Data Protection Statement

We are committed to protecting your personal information and complying with the Data Protection Act 1998 and associated legislation. We will treat all your personal information as private and confidential (even when you are no longer an active subscriber), except where disclosure is made at your request or with your consent or where we are required by law to disclose.

When referring to "personal information", we mean information we collect from you, from which you may be personally identified. This will include name, email address, phone number. The application will record your company name, personal name, email address, business address, and other information volunteered by you to us. Collected data is stored in a secure database.

We will not pass on any personal information you have given us to any other third party organisation under any circumstances.

Sharing of information

We will never sell or rent your personal information to third parties for their use without your consent. We may share your contact and other information with our partners for limited purposes, with certain third parties (who may only use the information for the purpose for which it was provided), with courts, law enforcement and other relevant third parties, or with our acquirer if we are ever acquired.

Cookies and Web Beacons

We use cookies and other technology to keep track of your online interaction with our Sites. Information gathered through usage of a cookie is not linked to any personal identifying information, unless you become a trial or paying customer.

Other data usage

We may use aggregated data over several users to improve our algorithms, measure service usage, publish summaries online or offline, and to develop new features. We will not display or otherwise disclose information where individual users can be recognised. Furthermore, our developers need to occasionally review raw data and the results for recognised diets/ locations/ outlets/ and food options to improve the system. Only those developers that require access to the raw data will be given access.

Sharing data with third parties

We do not disclose an individual user’s information to third parties unless (1) you have given explicit consent to such disclosure, (2) we are required to comply with a legal obligation, or (3) if our business or assets, or parts of them, are acquired by a third party. Third parties will be bound by applicable data protection legislation and/ or this privacy policy concerning the disclosed data.

The security of our systems

We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to provide the service. These may be located at destinations outside of England and the European Economic Area. By submitting your personal data, you agree to this. We use commercially reasonable physical and technical safeguards to secure your data. However we cannot guarantee the security of your data, which may be compromised by unauthorised entry or use, hardware or software failure, and other factors.

Your access to the data

At the moment, you can only access the data by using the software product. i.e you cannot export your data from our system.

You can update your vitalCustomer account information by logging in to your account. If you would like to suspend or cancel your vitalCustomer account or obtain further information about or access to your personal information, you can do so by contacting vitalCustomer customer support.

We will retain and use your information for as long as your account is active or as needed to provide you services, as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. Notwithstanding the foregoing, we may continue to disclose your storefront information to third parties in a manner that does not reveal personal information after you suspend or cancel your vitalCustomer account unless you request otherwise.

Changes to our privacy policy

We reserve the right to alter our privacy policy at any time. We will notify you of any alterations with reasonable notice through the service, by email or otherwise. If you do not agree to the altered privacy policy, you will not be bound by it if you stop using vitalCustomer before the alterations become effective.
